1About these terms
This website (https://datadynamicsau.com) is operated by Data Dynamics Australia Pty Ltd (ABN 40 668 030 457) (DDA, we, us). By using it you agree to these terms. If you do not agree, please do not use it. We may update these terms; the current version is always on this page. Services we provide are governed by an engagement letter, which prevails over these terms if they differ. Using the website or contacting us does not create a client relationship. Our Privacy Policy explains how we handle personal information.
2General information only
Content on this website is general information about DDA and its services. It does not take into account your objectives, financial situation or needs, and is not financial, investment, tax, accounting or legal advice. Before acting, consider whether it is appropriate for you and obtain advice from a suitably qualified professional. We take reasonable care with the content but do not warrant that it is complete, current or free of errors.
3Reliance on our work
Models, papers, reports and other deliverables we prepare for a client are prepared for that client, for the purpose stated in the engagement letter. Any reliance on them is set out only in the engagement letter. No other person may rely on them. Lenders, investors, appointees and other third parties who receive a DDA deliverable make their own assessment and their own decision. Forecasts and scenarios are estimates based on stated assumptions and are not promises of future results.
4What we do not do
DDA does not provide financial product advice, and it does not recommend that anyone acquire, hold or dispose of a financial product. DDA does not provide tax agent services or advise on tax liabilities. DDA does not provide legal services, manage money or lend. DDA does not provide credit assistance in relation to consumer credit. Where an engagement touches these areas, we work alongside your licensed adviser, accountant or lawyer, who remains responsible for that advice.
5Fees, commissions and success fees
Our fees are agreed with the client in writing before work starts. Some engagements may include a fee that depends on an outcome (a success fee), or DDA may receive a commission or other benefit from a third party such as a lender. Where that applies, the amount or how it is calculated, and who pays it, is disclosed to the client in writing before work starts, and we will not accept such a benefit without the client's agreement.
6Examples and testimonials
Documents, figures, names of entities and scenarios shown on this website are illustrative only. They use invented figures and do not describe any actual client. Testimonials are the words of real clients, shown without their names to protect their privacy; they reflect those clients' experience and are not a promise of any particular result.
7Our content
The content, design, logos and marks on this website belong to DDA or its licensors and are protected by copyright and trade mark law. You may view and print pages for your own use. You must not copy, adapt, publish or commercially use them, or use our name or marks to suggest an association or endorsement, without our written permission.
8Using the website
You must not use the website unlawfully; interfere with its operation or security; access it through automated means other than search engines that follow our robots.txt; or copy its content to train a machine-learning model. The website may not always be available, and we may change or withdraw any part of it.
9Third-party links
The website links to third-party services, including our scheduling page. We are not responsible for their content or practices, which are governed by their own terms and privacy policies.
10Liability
To the maximum extent permitted by law, and subject to clause 11, DDA is not liable for any loss arising from your use of, or reliance on, this website or its content, including indirect or consequential loss, loss of profit or loss of data. Where our liability cannot be excluded but can be limited, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
11Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, implied or imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot lawfully be excluded or limited.
12Governing law
These terms are governed by the law of New South Wales. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.
13General
If any part of these terms is invalid or unenforceable, it is severed and the rest continues to apply. Questions about these terms: Data Dynamics Australia Pty Ltd, ABN 40 668 030 457, contact@datadynamicsau.com.
